    • Nearly as large (85%) as FY2001 corporate income taxes ($63.4 million).

  • The total amount paid by smokers in North Dakota could cover the 2001-2003 biennium general fund appropriations for:

    • Bismark State, AND Lake Region State AND Williston State Colleges AND the North Dakota State College of Science ($53.6 million) COMBINED

Master Settlement Agreement Payments To Date



$86,643,746 has been paid to North Dakota since the Master Settlement Agreement was signed on November 23, 1998.



 





North Dakota Tobacco Laws


A summary of North Dakota state law is provided below

Minimum Age Customers must be 18 years or older to purchase tobacco products.  
Restricted Products Cigarettes, cigarette papers, cigars, snuff, or tobacco in any other form, including bidis (beedies).
Fine/Penalty Schedule for Selling to Minors Violators will be charged with an infraction punishable by a fine of up to $500. The procuring of tobacco products for minors is prohibited. Violators will be charged with an infraction punishable by a fine of up to $500.  
Affirmative Defense None.  
Minor Possession It is a noncriminal offense for a minor to purchase, possess or use tobacco products, including cigarette rolling papers. Violators who are 14 years of age or older will be fined $25. A law enforcement officer who cites a minor for a violation shall mail a notice of the violation to the parent or legal guardian of the minor within ten days of the citation.

None.  
Compliance Checks As a condition of receiving federal substance abuse block grant funds, federal law requires the state of North Dakota to conduct random, unannounced inspections of tobacco outlets to determine compliance rates. A state agency, city, county, board of health, tobacco retailer, or association of tobacco retailers may conduct compliance surveys, after coordination with the appropriate local law enforcement authority.
