Q:  One of our county councilman wants to hold a meeting soon with people interested in anti-smoking legislation.  This will be a fact-finding type of meeting, not a hearing on any draft legislation.


A:  I suggest you print out our Ban Damage and Ban Loss pages and bring them with you.  A lot of towns have decided not to talk more about a ban after seeing our material and Newsletter.  Once they know this is a serious issue with TWO sides to it and not just the one the Antismoking Extremists pretend there is...  they decide not to get involved. 
If they ask, more places say no than yes to ban talks and it only seems like "everyone is jumping on the bandwagon" because the Antismoking Extremists have the money, and those are the stories that make the major media.
Please let me know how it goes and if you want your meeting report online I'd be happy to add it to the Newsletter.


 


Q:  I am currently doing a debate in college on against the smoking ban and was wondering if you could give me some good points or tell me how I should go about debating this.


A:  Depending on where you are located, what the issues are there, check the left column of the Newsletter at http://www.smokersclubinc.com and click on the links.
Read about the Antismoking Extremists and how to fight them.
If your state is looking into having a ban, look into the Ban Damage and Ban Loss information pages.  Is this really what you want for your town or State?
Also check the Ban Damage articles, and your State News section links on the right of the page.
You are welcome to copy anything from the Newsletter you want, with a nod back to us. 
Please don't forget that a smoking ban is really a people ban and it is a property rights issue.  Not only are rights involved, but there is a great deal of "Second Hand Damage" done from bans that the Antismoking Extremists don't want you to know about.  We get mail from little stores in strip malls that are dying because the anchor store there is a bar that is going under since a ban.  We hear from children's groups that can't afford uniforms or the annual camping trip because no one will go to the bingo that used to give them donations.  Musicians write to us that they can't get work because the bars have no customers since a ban went in.  We see the full domino effect from a ban and it isn't a pretty picture.  It is also never covered by the media.  Nothing is more heartbreaking then a parent who can't feed his child because his income was just cut in half, or worse.  Real people, actual human lives are damaged because of bans; they are not numbers on a tally sheet.
False promises from well paid Antismoking Extremists that non-smokers will jump in and take the place of smokers in bars, bingo halls, bowling alleys, etc…  never come true.  Just lies and more lies. 
If every owner of every building simply put up a sign on his door saying what he wanted or didn't on his property (smoking, children, cell phones, perfume, etc…) the public would decide where to go and where to spend their money.  There is no reason to have a law telling adults how to run their business , or that they have to turn people away if they don't want to.
College is a time to look at both sides of every issue and question loudly when you are told there is only one side!
Please extend this help to any debate class on your campus and you have our permission to add us to any other reference list and syllabus in the future.
Many colleges have The Smoker's Club, Inc. resources listed for debate student's assignments.  The often asked question is, "You mean there really are two sides to this issue?!"  My answer is, "Yes."

Q:  Can you use this suggested reading to counter the anti-smoking groups "research" statistics?


A:  Thanks for sending this note. Almost everything at the Newsletter is from the authors themselves, and much of the rest from reader's submissions, and readers who write for us.  The Newsletter is a giant effort from a lot of people, and has turned into a wonderful resource for all to use.
Now if we could just get the word out that it's easier to be proactive instead of reactive where people bans are concerned....   problem is that most people don't find us until they need us, and then it's a battle situation.  Just recently I heard a big city told one of our associates that the ban wasn't on the agenda because "that can't happen here." 
Pass the aspirin please.  They all say that until it is too late and they find out they've been duped by the well-paid Antismoking Extremists that don't care what damage they leave in their wake.


 


Q:  Are there any laws requiring a designated smoking area for employees?  If so, where may I find these?  Thanks.


A:  Requiring...  no.  Employers have the right to have an approved smoking area or not.  Just like you can decide on a dress code, Internet access, cologne policy, private phone call rules...  anything you want or don't want at your place.  "Casual Friday" isn't mandated by law, but most employees have grown to expect it.  If you have smokers, accommodate them just as you would any other group of people.
If you've put a changing table for infants in your ladies room, or extra wheelchair considerations above what is required by law into your building, or supplied both coffee and tea water for your break room, or any of dozens of other things, you are already accommodating groups of people. 
Employers never have problems until they start singling out a group for persecution.  Would you line up your overweight employees and tell them they no longer have lunch breaks until they lose weight? 
You know where you want to draw the lines in making your employees happy.


 


Q:  What do you hear the most from readers?

"This can't possibly happen here"
"Someone else will take care of it"
"This can't possibly happen here"
"Oh my God... what happened?!!"
Human Nature. Plain and simple. The Antis bank on it. Until people are un-brainwashed... Most of our reader mail comes from people AFTER a ban. Most heard? "I can't believe this just happened!"


 


Q:  ... can they get away with this on campus?!!


A:  Yours is a story we hear over and over at the Club. Unless the Dean is an Anti smoker... he may listen to the reasoning where smokers are simply another group of students. A group that he is ALLOWING to be demonized, put down, made to feel uncomfortable, etc...
Also print out our Ban Damage page of people who have been hurt and killed because of bans and ask if this is what he wants to welcome to his campus.
Making a certain percentage of the students under his care put themselves into dangerous situations is opening up liability for future lawsuits.
Sane and rational people can deal with any "problem" in society... being over weight, your sexual preferences, your color, your choice of religion... think about it... we are all people and if we are not all treated the same then someone should be ashamed of how she raised her children!


 


Q: I need help for a paper I have due in a week. In (insert state here), is it legal for a company to fire and/or not hire smokers? Or is there a state law protecting smokers rights?


A: Please read our FAQ page, and check the Antis: How to fight page for info on what states have employment laws and the Employment topic for more employment articles. Good luck with your paper and use anything at our sites that you want, including the videos if you have a computer available for your report.


 


Q:  Is it true they banned smoking in cars in my State?
Q:  What happened at my town meeting last night?
Q:  What are the smoking in jail laws here? Do they have more freedom than I do?
Q:  What is the name of the idiot stick that brought up this ban?


A:  Check your State news from the right column of the Newsletter main page. Only the last 10 articles posted in that section will show. Do a search in the box at the top of the middle column to find what you want in your state. This is really nifty because if there are 100 articles in the section, you can still find the few that mention a topic you are looking for, your town's name, or your name, or your dog's name.


 


Q:  What about nursing homes?

We've been asked that a few times recently! Property owners can set their own rules... BUT... when you live in a room that you are paying for, isn't that your home and you should be able to set your own rules there? It's a tricky subject! Read the fine print on the paperwork, I bet there is nothing in there about smoking. Ask them if they want to be liable for elderly residents walking outside in the bad weather? Liability may scare them into only having bans in the hallway and entrance. Who knows? But do it as all the residents, not just one. Get a free consultation with a lawyer.


 


Q: How are taxes related to bans?


A: The Antis say that if there are bans, people will quit smoking. The politicians need the tax money so the more people that quit smoking the higher the tax goes. The tax also goes up for this percentage of the population when the government decides that only they should pay for the roads and other things that every citizen gets to use. (Imagine if they tried to get just the golfers to pay for a public road, or just the people with a dog in the house, or just the people with one political party affiliation, etc… ?)


 


Q: Thought you might pass this on... "Overnightsmokes.com" has taken money and refused to send cigarettes ordered nearly a month ago. Phone has been disconnected, no email address. Faxed a message after 2 weeks of no answers and got a sentence back saying they were in litigation and would send my money after....Not a comfort to a Soc.Sec recipient! Buyer beware!!! DONOT TRUST THIS OUTFIT. I talked to the Indian Reservation business office and they said they only issued licenses they could not do anything about this.


A: We get reader mail like this all the time. The other big topic is orders being held at customs from overseas. Do not fall for these websites.  We have watched fly-by-night web sites close with no notice and steal money from good people for over ten years. Please do not let it happen to you.


 


Q: Where can I get Marlboro coupons?


A: We have no access to coupons, but a reader wrote in recently that the Marlboro number 1-800-627-5267 does and they are open until midnight Monday thru Saturday.


 


Q:  If possible, could you send your newsletters to my new e-mail address?

Q:  Why didn't you answer my email?


A:  Either our spam program got it and we never did, or you wrote with the contact web form and didn't include your email addy so we could write back, or you wrote with a bad addy on purpose so we couldn't respond, or we did and it's in your spam box.
